Terms of Service

1. Who we are and what these terms cover

Trion AI ("the Service", "we", "us") is a Shopify application that adds AI-powered virtual try-on to ecommerce storefronts. These Terms of Service ("Terms") are an agreement between Trion AI and the merchant who installs the app ("you"). By installing or using the Service you agree to these Terms.

If you use the Service on behalf of a business, you confirm you have authority to bind that business to these Terms.

2. The service

Trion AI provides a storefront widget that lets your shoppers upload a photo of themselves and receive an AI-generated image of themselves wearing a product from your store, plus a merchant dashboard for configuration, usage tracking and billing.

Generated images are artistic AI renderings, not measurements. They approximate how a garment may look and must not be presented to shoppers as a guarantee of fit, size or exact appearance.

3. Accounts and eligibility

The Service is available to merchants with an active Shopify store. Authentication and identity are handled through Shopify; we do not maintain separate Trion AI accounts or passwords.

You are responsible for everyone who accesses the Service through your store, including staff accounts.

4. Plans, billing and quotas

Paid plans are billed through Shopify's subscription billing and appear on your Shopify invoice. Each plan includes a monthly quota of try-on generations; quotas reset monthly and unused generations do not roll over.

When your store reaches its quota, the try-on feature pauses for shoppers until the quota resets or you upgrade. Failed generations are not counted against your quota.

You can change plans from the dashboard at any time. Uninstalling the app cancels your subscription automatically. Except where required by law, fees already charged are non-refundable.

We may change plan pricing or quotas with reasonable advance notice; changes take effect at your next billing cycle.

5. Acceptable use

You agree not to use the Service to generate unlawful, infringing, deceptive or harmful content. You must hold the necessary rights to the product images on your store, and you must not submit photos of people without their consent or photos of minors.

You must not attempt to probe, overload, reverse engineer or disrupt the Service, circumvent quotas, or resell access to the Service outside your own storefront.

We may suspend or terminate access for stores that violate this section, with notice where practicable.

6. Shopper content and AI processing

Shopper-uploaded photos and generated results are processed transiently and deleted within 24 hours, as described in our Privacy Policy. Generation is performed by third-party AI infrastructure providers acting as our processors.

You are responsible for presenting the try-on feature honestly to your shoppers and for complying with the consumer-protection and privacy laws that apply to your store, including any notice or consent requirements in your jurisdiction.

7. Intellectual property

We retain all rights to the Service, including the widget, dashboard and underlying software. You retain all rights to your store's content, including product images.

To operate the Service, you grant us a limited licence to process your product images and shopper uploads solely to generate try-on images for your store. Generated images may be used by you and your shoppers; we claim no ownership over them.

8. Availability and changes

We aim for high availability but the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. AI generation depends on third-party providers and may occasionally be slow, unavailable or produce unsatisfactory results.

We may modify or discontinue features at any time. If we discontinue the Service entirely we will provide reasonable notice.

9. Limitation of liability

To the maximum extent permitted by law, Trion AI will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues or data, arising from your use of the Service.

Our total liability for any claim arising out of these Terms or the Service is limited to the amounts you paid us in the three months before the event giving rise to the claim.

10. Indemnity

You agree to indemnify and hold harmless Trion AI from claims arising out of your store's content, your use of the Service in violation of these Terms, or your violation of applicable law — including claims by shoppers relating to photos they did not consent to upload.

11. Termination

You may stop using the Service at any time by uninstalling the app, which cancels billing and triggers deletion of your data as described in the Privacy Policy. We may suspend or terminate the Service for breach of these Terms or where required by law.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be announced via the dashboard or email with reasonable notice. Continuing to use the Service after changes take effect constitutes acceptance of the updated Terms.
